POSH Act to be amended after 10 years!




Important Update: Changes Proposed in POSH Law


A new bill, Bill No. I of 2024, has been introduced in Parliament, suggesting significant amendments to the existing law. Here's a summary of the proposed changes:


1. Extension of the timeline for filing a complaint: Currently set at 3 months from the date of the incident or last incident in a series, this is proposed to be extended to a period of 1 year.


2. Removal of the provision for extending the limitation period: The power of the Internal Committee (IC) to extend the limitation for up to 3 months from the date of complaint receipt is proposed to be removed. Consequently, the IC would have unlimited discretion to extend the timeline for submitting complaints.


3. Omission of Section 10 allowing for conciliation: The provision allowing for conciliation (Section 10) is proposed to be omitted due to concerns that it may lead to influencing or pressuring the complainant into a settlement, thereby undermining the dignity of women.


Please note that these changes will come into effect upon notification by the Central Government in the Official Gazette.
